Divorce

Divorce is a legal process in which a judge or other authority dissolves the bonds of matrimony existing between two persons, thus restoring them to the marital status of being single.

Legal Separation

Legal separation is an alternative to divorce for people who do not wish to live together but do not want to end their marriage for various financial considerations (e.g. the need for medical coverage).

A couple is legally separated after filing for their Separation Agreement with the court. Simply living apart does not constitute legal separation. A legal separation involves a distribution of marital property and an agreement as to custody and visitation if the couple has children.
